Revision of Art. 183 (Form of National Appeal) of FIA's International Sporting Code: file an intention to appeal now, pay later.
9 April 2001:
FIA's World Council adopted the following text for art. 183 ISC, which shall have effect as of April 1st, 2001. The consequences of these changes are that a driver does not need to pay immediately when filing the intention of appeal, but within 2 days thereafter when filing the confirmation of appeal. So, in practice you can file your appeal, but pay later.Positive effect hereof is that drivers do not need to have cash with them during the event, at least not for filing an appeal.
It should be noted, however, that the fee is now always due and payable regardless whether you give follow up to the intention of appeal or not.
The new text f art. 183 ISC reads as follows:
"Every notice of appeal shall be in writing and signed by the appellant or by their authorised agent. The confirmation of an appeal to an ASN must be accompanied by such fee as shall be specified annually by that ASN.This fee becomes due from the moment the appellant notifies the stewards of the intention of appealing, as specified in Article 102, and remains payable even if the appellant does not follow up the declared intention to appeal.
If the appeal is rejected or if it is withdrawn after being brought, no part of the protest fee shall be returned.
If judged partially founded, the fee may be returned in part and in its entirety if the protest is upheld.
Moreover, if it is proved that the author of the appeal has acted in bad faith, the ASN may inflict upon them one of the penalties laid down in this Code."
